New Leaf Wellness SMS Messaging Terms and Conditions

By opting in to receive text messages from New Leaf Wellness or its subsidiaries and affiliates (“New Leaf,” “we,” “us,” or “our”), you agree to these SMS Messaging Terms and Conditions (the “Agreement”). Your participation in our text messaging service (the “Service”) is also subject to our Privacy Policy and Terms of Use, which are incorporated by reference into this Agreement.
IMPORTANT NOTICE:
Our Terms and Conditions require that disputes be resolved on an individual basis through binding arbitration rather than jury trials or class actions. If you do not agree to these Terms, you may not participate in the Service.
1. Providing Accurate Contact Information
By opting in, you confirm that the mobile number you provide is accurate and that you are the current owner or authorized user of that number. If your contact details change, including ownership of your phone number, you agree to notify us immediately at privacy@newleafcenters.com before the change takes effect.
2. Your Consent to Receive Automated Texts
By voluntarily providing your mobile number, you consent to receive recurring automated text messages (SMS, MMS, or similar technologies) from us regarding:
- Our products, services, promotions, and offers
- Transactional updates related to your relationship with us
Your consent is not a condition of purchase, and standard message and data rates may apply.
3. How to Opt-Out
Your participation is completely voluntary, and you can opt-out at any time. To stop receiving text messages, you can:
- Reply with any of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT
- Email us at privacy@newleafcenters.com with a request to opt out
After opting out, you may receive one final confirmation message before your request is processed. If you need assistance, reply HELP or email privacy@newleafcenters.com.
4. Your Responsibility & Indemnification
You agree to indemnify and hold New Leaf Wellness harmless against any claims, damages, or legal actions arising from:
- Providing a phone number that you do not own
- Failing to update us if your number changes
- Any claims under the Telephone Consumer Protection Act (TCPA) or similar laws
This includes covering reasonable legal fees and costs related to such claims.
5. Eligibility & Participation Requirements
To participate in the Service, you must:
- Be at least 18 years old
- Own a mobile device capable of two-way messaging
- Be a wireless service subscriber with text messaging enabled
Not all mobile carriers support our messaging service. Please check with your provider for compatibility.
6. Changes to This Agreement
We reserve the right to update these Terms at any time. Any changes will be communicated to you, and it is your responsibility to review this Agreement periodically. Continued participation in the Service after updates means you accept the revised Terms.
7. General Provisions
By using the Service, you confirm that you have the legal authority to agree to these Terms and that nothing in this Agreement conflicts with any other obligations you may have.
If any provision of this Agreement is found to be unenforceable or invalid, it will be limited or removed to the minimum extent necessary, and the rest of the Agreement will remain fully in effect.
